The positions

The Faculty of Law has 2 positions vacant for applicants who wish to obtain the degree of Philosophiae Doctor (PhD) . The positions are affiliated with the Norwegian Centre for the Law of the Sea (NCLOS). The work place is Tromsø.

The Faculty of Law has about 950 law students, 25 PhD fellows, 35 members of the academic staff and 15 members of the administrative staff. The Faculty may award the degrees of Master and PhD in Law as well as the degree of Master of Laws (LL.M.) in the Law of the Sea.

NCLOS have a staff of 20 - 25 employees; academic staff and PhD fellows. The Centre is located at the Faculty of Law, providing for close contact and collaboration between the staff. The appointment is for a period of four years. The nominal length of the PhD program is three years. The fourth year, distributed with 25% each year, will consist of teaching and other duties for the Faculty of Law.

The objective of the positions is to complete research training to the level of a doctoral degree. Admission to a PhD programme is a prerequisite for employment, and the programme period starts on commencement of the position. The PhD fellows shall participate in the faculty’s organized research training, and the PhD project shall be completed during the period of employment.

Field of research

The primary objective of NCLOS is to assess how and to what extent the law of the sea and ocean governance foster or can foster resilient and sustainable oceans in light of the challenges to the oceans and the legal framework. The objective is to be addressed through analyzing several hypotheses, including the contentions that the logic of sovereignty and common interests and the governance of oceans commons both need reassessment. NCLOS seeks candidates for two PhD positions that will contribute to investigating these hypotheses.

Position # 1: Sovereignty and common interests.

Sovereignty is a fundamental pillar of the law of the sea. Global challenges such as climate change and biodiversity loss raise questions as to the adequacy of sovereignty-based regimes. The PhD position is expected to analyse how sovereignty and other derived concepts both obstruct and provide solutions to the challenges to the oceans and their governance. One of the questions relates to how sovereignty-regimes may be rethought to better include common interests.

Position # 2: Legal framework for oceans commons.

The ocean commons or the areas beyond national jurisdiction include vast areas and resources. The PhD position is expected to investigate which ideas and how they have been integrated in the legal framework for oceans commons as reflected in the 1982 UN Convention on the Law of the Sea and supplemented by subsequent legal developments. Further, the position shall investigate the principles that operationalise these ideas. And further, discuss whether the Common Heritage of Mankind and Freedoms of the high seas provide adequate basis for protecting the marine environment and whether they provide for equity and justice.

Qualifications

The succesful applicants must fulfil the requirements for admission to the Faculty's PhD programme. Information about requirements is available here (genereal requirements for UiT) and here (complementary requirements/guidelines for the Faculty of Law).

Profiency in the English language as stated here is required.

Further, the applicants must have a five years Master’s degree in Law or cand. jur. with good grades. The Faculty may accept equivalent education in law from foreign universities.

The applicants must present a description outlining the academic basis of the PhD project. The project description shall not exceed 10 pages, literature references included. It shall include a description of the theme, research question(s) and a reasoning of the choices. It shall also indicate the methodologies to be used. The applicant may be asked to supplement the description.

Emphasis will be put on the candidates potential for research, motivation and personal suitability for the position.

The applicants must understand Norwegian or commit himself/herself to participate in the Norwegian Language Courses held by the UiT at the outset of the employment.

As many as possible should have the opportunity to undertake organized research training. If you already hold a PhD or have equivalent competence, we will not appoint you to this position.A shorter period of appointment may be decided when the PhD Fellow has already completed parts of their research training programme or when the appointment is based on a previous qualifying position PhD Fellow, research assistant, or the like in such a way that the total time used for research training amounts to three years.Remuneration for the position of PhD Fellow is in accordance with the State salary scale code 1017 or 1378 depending on qualifications. A compulsory contribution of 2 % to the Norwegian Public Service Pension Fund will be deducted.
